The founder of USA constitution were deeply influenced by the Enlighted Europeans. Famous personalities like George Washington, John Adams, and Thomas Jefferson all concurred that laws, rather than men, should be the final sanction and that government should be responsible to the governed.
John Adams was the mastermind and prescribed that a Constitution should be a balance of executive and legislative power checked by an independent judiciary.
This theory was known as Separation Of Power and Checks and Balance.
What is Separation of Power ?
It is a theory where the branches of the State i.e. Legislative, Executive and Judiciary called as trias politica model have independent power and responsibilities and all the branches are working within their own ambit without interfering in the functioning of other branch.
This theory is very important for the smooth functioning of the democratic model and helping in efficient and smooth functioning of the State's machinery.
This theory is also supported by another theory which is called as theory of Checks and Balance which would regulate and restrict the interference of one branch into another's sphere by keeping checks on the actions of the branch.
These two theories would be helpful in providing transparent functioning of the system without creating any autonomy attitude of any of the branch.
