The High Courts can create precedent. The decisions of a High Court are considered to be binding on all the courts below it within its jurisdiction.

The High Courts of justice is considered to be type of court which can make a decision which is said to be binding called a precedent. However, the authoritative precedents are the decisions of the superior courts of justice which are binding on subordinate courts.

However, a decision of the Supreme Court is cobinding on all the High Courts. By Article 141 of the Constitution of India it is said to laid down that the law declared.

Hence, the High Courts are bound by the law declared by the Supreme Court.
